Your Weingarten Rights

NLRB vs. Weingarten, Inc. 420 U.S. 25

  • You are entitled by law to union representation. Don't be misled into thinking you won't need it!
  • If called into a meeting with management, read the following to them before the meeting starts:"
  • If this discussion could in any way lead to me being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union representative, officer, or steward be present at this meeting. Without representation present, I choose not to participate in this discussion."
  • You must request Union Representation, the Company doesn't have to offer it.

Don't Sign

You do not have to write or sign any statement for the Company. (If you do, request a copy). If the Company request you sign a document, put something like I don't understand or I don't agree or something similar to prevent the company from sneaking unsigned documents in your file at a later time. When asked a question by the Company, if you don't recall, say you don't recall. (Don't try to fill in the gaps or guess). You have the right to information regarding the subject of the meeting before you participate. You have the right to consult with your Union Representative before and/or during the meeting.
